It is wildly unusual for lower-court judges to so publicly express frustration with the Supreme Court’s *behavior* (versus, say, a confusing ruling in a specific case). But the number of *different* examples is completely unprecedented—and pretty powerful evidence that something is seriously wrong.

I am usually more sanguine than some others when the Supreme Court hands down nasty opinions, but y'all, I am really stuck on Noem v. Vasquez Perdomo. Presidential immunity was dangerous but unsurprising. Many other shadow docket rulings have been dumbfounding. Today was nakedly invidious.

I don't know exactly how and when we'll get there, but there will come a time when the Roberts Court era and especially from ~2024 onward becomes treated as an irredeemably tainted anti-canon, when citing them as a favorable precedent joins the ranks of invoking Dred Scott, Plessey, or Korematsu.

BREAKING: The Supreme Court — over the objection of Justices Sotomayor, Kagan, and Jackson — allows the Trump administration’s racial profiling of people working certain types of jobs in its immigration raids during litigation.

SUPREME COURT OF THE UNITED STATES - No. 25A169 - KRISTI NOEM, SECRETARY, DEPARTMENT OF HOMELAND SECURITY, ET AL. U. PEDRO VASQUEZ PERDOMO, ET AL. ON APPLICATION FOR STAY [September 8, 2025] The application for stay presented to JUSTICE KAGAN and by her referred to the Court is granted. The July 11, 2025 order entered by the United States District Court for the Central District of California, case No. 2:25-cv-5605, is stayed pending the disposition of the appeal in the United States Court of Appeals for the Ninth Circuit and disposition of a petition for a writ of certiorari, if such a writ is timely sought. Should certiorari be denied, this stay shall terminate automatically. In the event certiorari is granted, the stay shall terminate upon the sending down of the judgment of this Court. JUSTICE SOTOMAYOR, with whom JUSTICE KAGAN and JUSTICE JACKSON join, dissenting. In early June, the Government launched immigration enforcement raids across Los Angeles and its surrounding counties. During the raids, teams of armed and masked agents pulled up to car washes, tow yards, farms, and parks and began seizing individuals on sight, often before asking a single question. A Federal District Court found that these raids were part of a pattern of conduct by the Government that likely violated the Fourth Amendment. Based on the evidence before it, the court held that the Government was stopping individuals based solely on four factors: (1) their apparent race or ethnicity; (2) whether they spoke Spanish or English with an accent; (3) the type of location at which they were found (such as a car wash or bus stop); and (4) the type of job they appeared to work. Concluding that stops based on these four factors alone, even when taken together, could not satisfy the Fourth Amendment's requirement of reasonable suspicion, the District Court temporarily enjoined the Government from continuing its pattern of unlawful mass arrests while it considered whether longer-term relief was appropriate. Instead of allowing the District Court to consider these troubling allegations in the normal course, a majority of 2 NOEM v. VASQUEZ PERDOMO SOTOMAYOR, J., dissenting this Court decides to take the once-extraordinary step of staying the District Court's order. That decision is yet another grave misuse of our emergency docket. We should not have to live in a country where the Government can seize anyone who looks Latino, speaks Spanish, and appears to work a low wage job. Rather than stand idly by while our constitutional freedoms are lost, I dissent. * * The Fourth Amendment protects every individual's constitutional right to be

It's not the most important part of the issue but Kavanaugh saying "well they should just sue if they're the victims of excessive force from ICE" when he himself has previously voted to bar lawsuits against federal officers for violations of the 4th Amendment in immigration cases takes chutzpah.

The injunction is silent as to the use of force. And it is not necessary for the injunction to address that use-of-force question because the Fourth Amendment’s reasonableness standard continues to govern the officers’ use of force and to prohibit excessive force. To the extent that excessive force has been used, the Fourth Amendment prohibits such action, and remedies should be available in federal court. I agree with the dissent on that point. But to reiterate, this injunction against brief stops for questioning does not address the useof-force issue.

The practical upshot is that justice delayed is justice denied; or to be more precise, a lab which had to fire all of its researchers and halt work on groundbreaking research isn't going to be able to ever restore itself to the same position it would have been without a multi-year pause in funding.

While Trump has no actual power to do this, it's telling that he wants to take the advice of a dictator to harm the integrity of our elections. Even though the courts will likely block this order, we should be horrified that he is attempting this at all. This is a direct attack on democracy.

This ruling is so much worse than you described. As Justice Jackson laid out, it functionally prevents any meaningful remedy when the government violates the law to cancel contracts. And Barrett's opinion calls into question whether she would even rule against the admin -- your silver lining.

August 19, 2025 PA-2025-16 Policy Alert SUBJECT: Clarifying Discretionary Factors in Certain Immigration Benefit Requests Purpose U.S. Citizenship and Immigration Services (USCIS) is updating policy guidance in the USCIS Policy Manual regarding the factors that officers may consider in certain benefit requests where an exercise of discretion is required, including factors relating to aliens’ past requests for parole and any involvement in anti-American or terrorist organizations. Background For certain immigration benefit requests, such as adjustment of status, the alien bears the burden of proof to demonstrate that a favorable exercise of discretion is warranted.1 For these benefit requests, the discretionary analysis is a separate component of adjudicating the benefit request which occurs after an officer determines whether all threshold eligibility requirements have been met. The act of exercising discretion involves weighing positive and negative factors and considering the totality of the circumstances in each case. There are various factors officers may consider when conducting a discretionary analysis, including facts relating to an alien’s conduct, character, family ties, immigration history, and any humanitarian concerns. USCIS guidance provides that an alien’s compliance with immigration laws is a relevant factor when determining if a favorable exercise of discretion is warranted. USCIS is updating the Policy Manual to provide additional guidance for officers on the significant negative discretionary weight USCIS assigns in circumstances where an alien has endorsed, promoted, supported, or otherwise espoused the views of a terrorist organization or group, including those who support or promote anti-American ideologies or activities, antisemitic terrorism, antisemitic terrorist organizations, and antisemitic ideologies, in any case involving an exercise of discretion.2 In cases where the alien has engaged in such activities, USCIS will enforce all relevant …

Disparate impact would be exceptionally hard to do here. You’d have to identify a neutral rule or device that is the cause of the uneven outcome. If you attempted to do a pattern or practice kind of analysis, identifying the labor pool across different departments and schools would be challenging.

The Arkansas General Assembly prohibited healthcare professionals from providing gender transition procedures to minors. The Act also prohibited the professionals from referring minors for gender transition procedures. Four minors living in Arkansas, their parents, and two healthcare professionals practicing there sued to enjoin the Arkansas Attorney General and the members of the State Medical Board from enforcing the Act. Ruling that the Act violated the First Amendment and both the Fourteenth Amendment's Equal Protection Clause and Due Process Clause, the district court issued a permanent injunction. The Attorney General and the Board appeal. Having jurisdiction under 28 U.S.C. § 1291, this court reverses and remands.
