There was some discussion of this at the SCOTUS oral argument. The SG didn’t take a position, but she acknowledged there is an argument that a statutory extension generally can be granted even after a statutory requirement has become effective.

Very interesting order. It’s odd for a merits panel to immediately undo the work of their colleagues sitting on the motions panel. If there were some kind of changed circumstances, perhaps it would justify an order like this. But in the ordinary course, I’d think they’d just vote for en banc.
