I never said you were making a moral judgement. Others upthread were. “Every penny” is a quote from a skeet upthread. I have not opined on the likelihood of anyone winning such an award. I have agreed with your prior skeets. Not sure what the issue is here, so I’ll just say have a nice day.

Yes, that’s my point. Suing for “every penny” isn’t about enriching oneself. It is about depriving a defendant of resources. But even if it wasn’t, I think moral judgments about greedy plaintiffs are doing the work of those who would rather not see accountability. It’s the system we have.

I’m sure if this goes to trial, this and other questions will be raised. On this one, I would also ask “does the product come with a manual?” And “would the user know that they are bypassing safeguards, and how would they know?” And “what safeguards are in the product for children, if any?”

Agree. And even if they only sought damages, unfortunately that is the best our courts can do most of the time. In the U.S., saying that people shouldn’t sue because “they are only after money” implies that if firms do damage they should have no deterrent. It shelters wrongdoing.

These are three separate potential legal theories. A plaintiff would necessarily bring all those theories. They might bring more. They would only need to win one. In other words, yes, a machine could potentially be held to a different standard than what you believe you would be held to.

Product liability does not require that a person used AI as a therapist. I can’t teach a tort class by skeet. I can just raise awareness. What is a reasonable expectation is up to a jury to decide. The filing also lays out facts that could be used to make a case for encouragement.
