For the nonlawyers, "arbitrary and capricious" is an important standard federal courts use to decide whether agencies are (1) doing their job under the law or (2) wielding power without principle. The Roberts Court is definitely doing 2 but the only way to stop them is to rebalance the court.

Higher Ed Has a Bigger Problem Than Trump Universities should see the president’s interventions as a wake-up call, not the root of their troubles. By E. Thomas Finan Universities can begin to assuage this skepticism by committing to addressing America’s biggest problems, starting with polarization. American colleges must become a venue for the frank but charitable exchange of ideas. College is not simply a debating society, yet many schools risk stifling dialogue, even if unintentionally. A recent study of University of Michigan and Northwestern University students by the psychology researchers Kevin Waldman and Forest Romm found that 72 percent reported self-censoring their political beliefs. Perhaps more troubling, 82 percent had turned in work that misrepresented their beliefs “to align with a professor’s expectations.” Such pervasive self-censorship not only undercuts universities’ academic mission—it also validates the widespread suspicion that campuses replicate bias instead of challenging it.

Underrated challenge to fascist consolidation is that while MAGA has lots of bad faith actors in all three branches of government, their base of support depends on people who believe themselves to be decent and honest, and might be duped by propaganda but don’t intend to personally lie or cheat

The problem cuts both ways as you said, and i think in both cases it boils down to the fact that tackling the problem is both doable and also very hard, and people don’t want to take responsibility for it

I think people really struggle w partially consolidated authoritarianism, either understating our problem or understating our power It's like we're in a liminal fascist space. And not recognizing how far gone we are or thinking we're simply too far gone are both grave errors we can't afford to make
