Via memos tonight, the government finally confirmed what it should've said upfront: the illegal H1B ban and fee only applies to petitions filed after 9/21. That's good. And we'll still see them in court. They could've avoided all this chaos but they wanted it.
This regime lies about everything all the time. The black letter wording of the proclamation relates to all H1B entries. They could've been more precise, but they're all nitwits and terrible writers. So I can't advise without proof of what the rumors are. Simple as that.
Seeing reports about this "unnamed White House official" who said that the H1B proclamation doesn't apply to returning workers. If the official was authorized to provide this info, they should've gone on record. Until I see a memo or get a named person with this info, the clarification isn't real.
This $100k fee is an existential threat to the US. This country cannot function without H1B workers. We thrive as a nation of immigrants.

Oh haha!! Yes, by taking away TPS from folks, they become undocumented when it expires unless they change status or leave. Their are so many vulnerable folks who have nowhere to go (thinking re Haitians especially). Courts keep saving it but it all feels so tenuous.

Indeed. Sometimes the courts stave it off; sometimes not. And many people have no alternatives to stay. Anyone affected by parole or TPS terminations really needs a well-informed, competent immigration lawyer. On the H1B side, it's way too early to tell what the heck is happening.

We haven’t seen the text of this yet, but to be clear, the president has literally zero legal authority to impose a $100,000 fee on visas. None. Zip. Zilch. The only authority Congress has ever given the executive branch here is to charge fees to recover the cost of processing the application.

Understood. I'm hearing some skepticism that the reporters got the information right, so I'm trying to be measured in my communication about it.
I think we need to wait and see what comes out. My office is getting calls and emails already based on this reporting & it's bizarre. We really need not freak people out at the moment. Plus, I think this would meet a successful court challenge. This fee is unconscionable.
I'm not sure the reporting is accurate. But even if it is, lawsuits will be filed swiftly. I think we need to be skeptical here.
95% of my law practice is physician immigration. I file H-1Bs for doctors almost every day. If this reporting is accurate, I still believe this fee is not likely to be implemented (and certainly not without a fight). Let's not lose our heads in outrage.
