The point of the European Convention on Human Rights is that it is a set of basic rights provisions, the interpretation of which can move with the times. There is already a 'margin of appreciation' given to states, frequently VERY generously, in that interpretation, by the Court.

They both were/are systems of Fascism w 2 differences being most people in Germany in the 30s could not escape, poor or unaware, as many were.
