Moreover, the injury to President Trump’s business and personal reputation inflicted by these Defendants threatens to Case 8:25-cv-02487 Document 1 Filed 09/15/25 Page 79 of 85 PageID 79 80 continue, thereby causing massive economic damage to his brand value and significant damage and injury to his future financial prospects. The harm to the value of TMTG stock is one example of how the Defendants’ defamation has injured President Trump. Selective targeting of political opposition isn't something you can layer on top while otherwise still doing normal law enforcement. Nothing then is credible, the taint is inescapable. The government can't credibly represent any honest interest in enforcing the law. It destroys its own legitimacy.

Dear Chancellor Lyons and Chief Campus Counsel Robinson, We write to protest the University of California’s (UC) release of documents to the Department of Education’s Office of Civil Rights (OCR) containing the personally identifiable information (PII) of 160 UC Berkeley faculty, students, and staff. Our members report that this disclosure has caused them significant harm, including chilled speech and association and, among non-citizens, heightened fear of detention and deportation. We believe the release of PII was wholly unnecessary and legally improper. As you know, an OCR investigation is not intended to determine whether students, faculty, or staff have violated any civil rights laws, but whether the university itself is in compliance with Title VI’s nondiscrimination mandate. Personal information about individuals associated with discrimination complaints is irrelevant to a legitimate investigation into an institution’s management of such complaints. OCR’s demand for the broad disclosure of names of “all” individuals who have a “potential connection to reports of alleged antisemitism” does not meet the standard of relevance, and creates a substantial risk of harm to those individuals, including to their substantive and procedural rights under the Constitution. Indeed, public statements by members of the Trump administration and the actions of the President's Taskforce to Combat Antisemitism make clear that the broad request for such personally sensitive information is intended to incite individual and institutional fear and thus chill First Amendment rights. By succumbing to this fear and complying with this overbroad and unlawful request, the University has participated in the chilling of speech and association rights of students, staff, and faculty.

But Santos’s complaint contradicts any claim of a purpose on the Defendants’ part to “supplant” Santos’s “commercially valuable right” in the videos. Swatch Grp. Mgmt. Servs. Ltd. v. Bloomberg L.P., 756 F.3d 73, 83 (2d Cir. 2014) (quotation marks omitted). To the contrary, the complaint paints a portrait of defendants motivated by (sarcastic) criticism and commentary. See Authors Guild v. Google, Inc., 804 F.3d 202, 215–16 (2d Cir. 2015). We thus agree with the District Court that the first factor strongly supports a finding of fair use. We are equally unpersuaded by Santos’s challenges to the District Court’s analysis of the remaining factors. Among other things, the relevant copyright registrations establish that the videos were published on the same day they were created. See App’x 160–69; 17 U.S.C. § 101. And it is clear on the face of Santos’s complaint that Santos has not suffered market harm within the meaning of the fourth fair use factor because “[w]e ask not whether the second work would damage the market for the first (by, for example, devaluing it through parody or

DOJ has moved to drop the charges against still another person accused of assaulting law police during Trump's D.C. surge. This case involved a man who allegedly tried to flee from ICE agents, causing one of them to scrape his knee. (The normal number of cases DOJ drops like this is near zero.)

I just got the most unintentionally funny legal threat from a guy who sent me a harassing message on LINKEDIN (Lolol) and when I screencapped it and told his employer to “come get your guy” he sent me an email threatening to take me to court for tortious interference

Your conduct squarely constitutes tortious interference with contractual and business relations under New York law. New York courts recognize a claim for tortious interference where: (1) a valid employment relationship exists, (2) the defendant has knowledge of that relationship, (3) the defendant intentionally induces or causes a third party not to continue the relationship, and (4) damages result (see Guard-Life Corp. v. S. Parker Hardware Mfg. Corp., 50 N.Y.2d 183 (1980); NBT Bancorp Inc. v. Fleet/Norstar Fin. Group, Inc., 87 N.Y.2d 614 (1996)).

As I noted in my 2024 post, this case is part of a larger ongoing patent dispute between these two companies and there is also a good amount of interesting strategy where Pioneer has obtained patents while keeping the parent lines secret. Abstract Academic and market interest in environmental, social, and governance (ESG) investing has grown markedly in recent years. Although less prominent, a substantial literature also explores whether “sin pays” in the public capital markets. This literature’s underlying theory is that social norms discourage the funding of businesses that promote vice. According to this theory, some investors—particularly institutions sensitive to social norms, such as pension funds and foundations—will shun vice investments. A consequence of this aversion is a “vice premium” for those investors who will invest in such companies. Largely unexplored, however, is what industries or business models qualify as “vice,” how this definition is constructed and changes, how vice aversion affects startup corporate governance and finance, and what consequences vice aversion holds for the real economy. We address these gaps through a series of interviews with startup founders, venture-capital (VC) and angel investors, and legal and financial practitioners. Descriptive data from commercial VC databases supplement our interviews. We find that the definition of “vice” is nuanced and shifts over time as the subjective preferences of investors and their constituents adapt to changing regulatory environments and social mores. Our respondents report that vice startups face heightened regulatory and business-infrastructure hurdles compared to non-vice startups. This experience is especially true for women and other minoritized vice entrepreneurs and those serving minoritized customer bases. These challenges implicate entrepreneurship, society, and capital markets, including by complicating the concept of the vice premium in finance theory and by showing the potential for vice aversion to shape both the vice and non-vice sides of the real economy.

"Shut the fuck up" has long been the correct default advice on talking to the police but now it applies 100x if it's federal law enforcement or if the info might get to them. It's not just that what you say will be used against you; you will also instantly be burned for political expedience.
