Gov't could've sought to reopen with a motion to the imm court (they could've done so to try to get rid of the withholding order). My understanding is that Abrego Garcia has submitted his own MTR and it's already pending. If the IJ, grants it, then clear no order to execute while he seeks asylum.

Reinstatement requires an illegal re-entry per 1231(a)(5). So even if they revoke parole, they can't reinstate.

Makes intuitive sense to me. They had an order of removal. It was executed upon his departure. He was then brought back in without anyone (yet) reopening the old already-executed order. You can't execute one removal order twice (reinstatement not applicable here). No order to execute right now.

So ultimately people, many of whom waited to enter w/ an appt on the CBP One app and had pending asylum applications were renditioned to another country’s torture prison to be used as leverage in negotiations for the release of political prisoners… from the very govt they’d been seeking asylum from.

Also worse because at least sometimes, police have their cases get thrown out for unconstitutional actions. This almost never happens to immigration cases and they don’t seem to face internal discipline either. So all incentives are to run roughshod.
