Gov't could've sought to reopen with a motion to the imm court (they could've done so to try to get rid of the withholding order). My understanding is that Abrego Garcia has submitted his own MTR and it's already pending. If the IJ, grants it, then clear no order to execute while he seeks asylum.

Reinstatement requires an illegal re-entry per 1231(a)(5). So even if they revoke parole, they can't reinstate.

Makes intuitive sense to me. They had an order of removal. It was executed upon his departure. He was then brought back in without anyone (yet) reopening the old already-executed order. You can't execute one removal order twice (reinstatement not applicable here). No order to execute right now.

Just read it and with that... not exactly rigorous analysis of Virginia's definition of the term "obscene," I'm not sure this Board is too concerned with its decisions having the power to persuade federal courts.

I haven't seen any of the dismissal notices from the asylum office and have no idea under what purported authority they're declining adjudicate properly filed applications.

The Bove allegations should be treated as something akin to Watergate, or Iran Contra. The administration was attempting to do something they *knew* was illegal (anticipating the courts saying as much), and then trying to COVER IT UP. Only here instead of it being run out of the WH or NSC, it’s DOJ

Where were the lawyers? Knee deep in the lawlessness, of course.

This is a horrifying ruling that shows a disdain for basic human rights principles — made all the more unconscionable by the fact that the Republican appointees did so with no reasoning and on the shadow docket.

Emergency stays at SCOTUS are a carnival game with no instructions or rules beyond the people running it winking at certain players.

It was great to see people, for sure! Just bummed I didn’t know @asgvisalaw.bsky.social was here or I would have stalked him to finally meet him in person.

COMMENTARY: It takes a great country to admit its mistakes. The Trump administration's new signs at Colorado's National Historic Sites reflect weakness and insecurity.

The audacity of Tom Homan to say this on The Daily as ICE arrests people at their immigration court hearings—including those who waited for U.S. gov’t permission to enter the country and file their cases and who have attended every check in and hearing.
