He's been able to act with more impunity (though, notably, not without limit) in the immigration sphere mostly because of decades of SCOTUS precedent *prior to this administration* basically turning immigration enforcement into a personal fiefdom of the President.

It's vital to remember that, while Trump clearly WANTS to act like he's consolidated autocratic power, he very much has not. Lots of courts are still telling him "no," and by-and-large he's having to eat those rulings. Lots of institutions are actually standing up to him, and often winning.

And, what's more, this judge is a big-time Republican, previously best known for tossing out COVID restrictions. If I were one of the Trump lawyers whose name was on this complaint, I'd resign from the Bar, move to another state, and change my name. Maybe open a bar, or raise goats or something.
Dr. Jimbosaur, Esq. (@jimbosaur.bsky.social)
For non-lawyers: this judge tossed Trump's suit on Rule 8 grounds, which is a thing that I've literally never even heard of happening to a filing by an actual lawyer. It basically only ever happens to people representing themselves (and typically only those who are mentally unwell).

Does Darrell Issa think you're not allowed to (falsely) shout "FIRE!" in a crowded theater because doing so will cause the theater to catch on fire? Does he think that's how fire works? Does he think people are shouting so loud that the friction of their sound waves is igniting the upholstery?

But what's infinitely worse, is that this model of discourse precludes the idea that any ideas, no matter how disgusting & discredited & debunked, can ever be settled. That any conclusion can ever actually be drawn. That the targets of hate can ever securely say they've won their place at the table.

Any half-talented sophist, no matter how hateful and vicious (or even violent) his ideas, can couch them in genteel terms. And if decent people calling those ideas what they are risk being chastised & excluded for "incivility," then the field is tipped in the hatemonger's favor.

The best they can muster is the idea that what makes disagreement "reasonable/unreasonable" has nothing to do with content, but rather *only* tone & presentation. Whether you're wearing a nice shirt and avoiding curse words (though, notably, not always slurs), or a ratty hoodie and shouting.
Dr. Jimbosaur, Esq. (@jimbosaur.bsky.social)
What gets me is the refusal to acknowledge that "tolerating reasonable disagreement" *necessarily* means there is such a thing as "unreasonable disagreement," which ought to be intolerable. And none of the people canonizing Kirk seem willing to say what beliefs of his they think are the former.
