New: I looked at 90 porn sites to test the new age-verification law rewriting the web. The ones following the rules, and scanning visitors' faces, are crumbling, while the lawbreakers are doubling or tripling their traffic. That's your interpretation. I've been fighting this fight, hard, for almost a decade. I became a law professor to give me more avenues to keep fighting. I also present things how they are. If that sounds like "giving up," that's your perspective. Not mine.
This is a tragedy -- not just for a growing concern like Bluesky -- but for all the Mississippi users who have found a sense of community or belonging on the site. In addition to their other flaws, these laws absolutely destroy important resources for people to foster and maintain their communities
worth noting the reason Bluesky is blocking Mississippi users rather than complying with their age verification law is bc Bluesky is the perfect example of a smaller site that may shut down bc of the high costs of age verification, which will further centralize the internet

And it's not going to stop there. They're talking about VPN and encryption bans now. The U.S. is eager to do the same. In the plainest of terms: things are going to be very fucked up. The privacy and online speech folks have been screaming about this for years now. It's here.
What's happening in the UK is a preview of what's to come. It's not some funny little thing the Brits are doing overseas. That is a window to our reality.

The new normal is going to be submitting your face or ID to any online service you wish to continue using. That should make you very angry.
I also don't think folks in the U.S. realize how dangerously close we are to UK style restrictions online. The Supreme Court greenlit age verification this summer. The minute a KOSA type law passes (and it will), that's it for us. It's here.

Keeping up with UKOS is fine if you have a giant public policy team like Meta or Alphabet. But for me, or small NGOs, or Wikimedia... It's a meaningful barrier that you can't understand what is going on without reading twenty interconnected documents and understanding a complex procedural history.
In looking at the impacts of the UK Online Safety act, a huge takeaway is not more transparency, but rather the emergence of a thicket of snarled law you must wade through to understand anything Which of course increases dependence on European consultancy now necessary to meet compliance standards…

There are only a few great scholars working tirelessly on SAD Scheme. @design-law.bsky.social in particular is deep into this issue and I highly recommend following her excellent work on it as well. We need more procedural watchdogs. It's thankless work at times, but so so critical.
I first learned about the scheme from @ericgoldman.bsky.social a few years ago. It felt blatantly wrong and yet, completely routine. This isn’t just about overseas counterfeiters. It’s about preserving due process under all circumstances, especially at a time when our govt is so eager to erode it.
I think it was @smmarotta.bsky.social who noted that even if the rule of law feels dead, there are still critical fights to win on the ground. This is one. Kudos to @ericgoldman.bsky.social & co for taking it up and to the judges finally acknowledging the SAD Scheme’s flagrant procedural abuses.

I am no law professor, but what I always remember is the vast majority of lawyers never deal with the hottest-button issues. They handle traffic offenses and divorces and slip-and-falls and trusts-and-estates and medical malpractice, all areas where the Rule of Law is alive and well. /1
