“Lawless: How the Supreme Court Runs on Conservative Grievance, Fringe Theories, and Bad Vibes,” Leah Litman (2025) The summer has become a gloomy period among lawyers, as we wait for the U.S. Supreme Court to close out its session and release its final flurry of rulings. How did we get to the point where we refresh our feeds to see what’s left of bedrock constitutional precedent? Leah Litman, a law professor at the University of Michigan and co-host of the “Strict Scrutiny” podcast, unpacks the conservative turn on the SCOTUS bench in recent decades, blending legal history with her signature snark. – Shawn Musgrave

Just an astonishing, powerful op-ed that drives home what we are losing and what's already been lost. We are so incredibly fortunate to live with the advances modern medicine and health science. Destroying and stymieing it is just unforgivable. Gift link: www.nytimes.com/2025/09/01/o...

5th Cir., 2-1, holds that Texas' ban on compensating people who assist voters with mail-in ballots is not preempted by the Voting Rights Act. Held: federal law does not really mean what it says. www.ca5.uscourts.gov/opinions/pub...

At bottom, nothing compels us to read “a person of the voter’s choice” in a maximalist way that erases swaths of state election laws.Context and common sense counsel a more restrained reading—one guaranteeing eligible voters help from “a person”18 of their choice, while allowing states to superintend voter assistance. Recall, moreover, that we are reading the phrase, not in the abstract, but in the context of a preemption claim that faces steep odds. As a “purposes and objectives” claim, it must surmount a “high threshold.” Barrosse, 70 F.4th at 320. As a claim involving core state authority, it must demonstrate Congress’s “clear and manifest” intent to preempt. See Deanda, 96 F.4th at 761. Section 208 comes nowhere close to meeting those standards. So, the district court erred by relying on the text of Section 208 to find preemption of the Compensation Provisions.

BREAKING: A unanimous Ninth Circuit three-judge panel upholds a lower court's order that blocked Sec. Noem's effort to cancel TPS status for Venezuelans. (B/c of a prior SCOTUS order staying most of the district court order pending appeals, though, this basically just sets up a SCOTUS appeal.)

The TPS statute is designed to constrain the Executive, creating predictable periods of safety and legal status for TPS beneficiaries. Sudden reversals of prior decisions contravene the statute’s plain language and purpose. Here, hundreds of thousands of people have been stripped of status and plunged into uncertainty. The stability of TPS has been replaced by fears of family separation, detention, and deportation. Congress did not contemplate this, and the ongoing irreparable harm to Plaintiffs warrants a remedy pending a final adjudication on the merits. AFFIRMED.14

Hi all, I am on the legal academic job market this year. My job talk paper focuses on pronatalism in tort law, and the complexity of claims seeking recourse for deprivation of abortion in light of Dobbs. Happy to send it upon request, feedback is always welcome! papers.ssrn.com/sol3/papers....

A little less than 15 mos. after the bike accident / broken elbow / elbow reconstruction surgery, I did the Swim To The Moon 10k - in less than 3 hours. Finishing it felt … amazing - and a way to mark a recovery and how much work went into it. Pictured w/(part of) the elbow scar.

Grateful for this extremely kind review of LAWLESS in the LA Review of Books!! lareviewofbooks.org/article/why-... "As Litman writes, 'It’s time to call their bluff.' And it’s time to read this book!" So get on it! bookshop.org/p/books/lawl...

DO YOU WANT to know why today’s Supreme Court rules like it does? Leah Litman, professor of law at the University of Michigan, has the answer, and it is one that people should know. In her terrific new book on the Supreme Court, Lawless, Litman pulls no punches, using her vast scholarly knowledge, together with down-to-earth language and fun analogies to movies and television shows, to persuasively demonstrate how the Republican Party has captured the Supreme Court through the tools of “conservative grievances, fringe theories,” and what Litman’s subtitle calls “bad vibes.”

I loved this about “Lawless”: impeccable analysis, irreverent wit, & contemporary cultural references are an ingenious combination — a way to understand the ethical & intellectual collapse of the SCOTUS without despairing.

What's especially amazing about Hagerty's attempt to say the quiet part out loud here is that it's brilliantly self-defeating: If the Constitution had to specify (in an odious way) how to count *even enslaved people* in the Census, that's only that much more evidence that *everybody* gets counted.

To what extent should law school classes be focused on the law on the ground as compared to the law on the books? Today’s bonus issue of “One First” looks at this age-old pedagogical question—and how it’s taken on special significance (& importance) in the fraught moment in which we find ourselves:

Constitutional law's substance has changed considerably since I first taught it 33 years ago, but the challenge now is less about teaching new doctrine than about integrating traditional coverage into the current authoritarian context. On the blog, I explain my plans for the coming semester.👇
