END/Will Trump open Pandora's Box and criminally pursue Bolton? It will change the landscape of all prepub policies but Trump does what Trump wants regardless of law, practice or policy.
5/Now, historically those violations are never pursued by the government. So long as the final published product has received approval, all is good. But those norms no longer necessarily exist during this Trump 2.0 administration.
4/Why is that relevant given same official, after extensive back & forth w/Bolton, later informally cleared book? Bc before she was given copy, Bolton's literary agent & publisher had it. Those disclosures constituted unlawful dissemination of National Defense Information under Espionage Act.
3/More importantly, he does potentially face real legal liability. When he properly submitted his 500 page manuscript to the White House for review, it contained voluminous amounts of classified information. That's not my words. That's what govt official who handled the review told Judge Lamberth.
2/Regardless of extent to which Bolton's prepub process was politicized, the fact remains he did not receive formal authorization to publish his book. His remedy was to sue the govt over the process, as I do for my clients regularly in these situations, not decide on his own that he could proceed.
