If it’s under Title 32 authority, the Texas guard remains under state control. That would mean that one state is deploying armed forces into the territory of a non-consenting state. And that’d clearly be a violation of the principle that states are co-equal, territorially limited sovereigns.

So the Constitution is just a piece of paper now, right? It, like all laws in this country, are no longer worth the paper they are printed on.
This to me is the defining quality of the rule of law: If an official gives an illegal order, then people do not follow it. The Fed is in a stronger position to uphold this principle than a lot of other institutions.
