If I'm obliged to speculate about this I would wager that, primarily, people concerned about crime live in areas with a significant amount of crime. It's not a nationwide epidemic, but I think it's naive to act as though crime simply isn't an issue at all everywhere in the US.

I'm not a scientist. To be honest I don't really care whether my interpretation is scientific or not. This conversation has gone well beyond tiresome so I'm going to leave it here and never look back.
I haven't made any statements about what science should or should not do.
That's the line of logic I'm following here. The fact that something -can- happen does not mean it is common or "normal". That's how I can acknowledge that intersex people exist but do not invalidate my saying humans are a binary sex.
People can be born missing limbs, but would you change your definition of a human/humanoid such that the number of limbs isn't part of it? To say a human has two arms doesn't mean someone with only one, or no, arms isn't human.
They're intersex. However that doesn't represent a unique component with regards to sexual reproduction. One person with both halves. It represents an (not being derogatory) abnormality rather than something "standard".

The penis is a male reproductive organ. Were the individual in possession of a full compliment of reproductive organs they would produce sperm. My criteria does not explicitly require an individual actively produce sperm and if you have gleaned that from my replies I apologize for being unclear.

An individual does not become disqualified from their sex if they are incapable of reproducing. As I said before I would only qualify someone as sexless had they no reproductive organs at all. Anything else would still fall into one or the other.
I am not saying or attempting to imply that biology is simple. You bring up individuals missing specific organs but are not born completely lacking genitalia. Those instances would not change my assessment. i.e.: Penis but no testes is still male. Vagina but no uterus is still female.
The short answer would be yes. I am tired of typing out the long answer.

Sperm is produced by males. Eggs are produced by females. An individual that can produce both is intersex. A lack of fertility or the loss of organs to accident or disease does not change this.
It does not matter if you are infertile or have lost those organs, or the capacity to use them, due to some accident or disease. Those individuals would still represent some half were it not for that happening. The active capacity to reproduce is not the defining factor.
I would only qualify a human as sexless were they born without any reproductive organs. I'm not certain if this is a thing that has happened (it probably has) but outside of that context everyone is born with something in some fashion.
This is my understanding of the subject and the context for my use regarding humans being a binary sex.
So far as I am aware humans are born as either male, female, or intersex which represents a mixture of male and female reproductive organs which may, or may not, develop fully. However I do not view intersex as a distinct sex as it does not provide a unique part in sexual reproduction.
Sex as pertaining to sexual reproduction. Male and female possess two disparate parts necessary to produce offspring. I do not disqualify (or change the definition of) these sexes based on someone's willingness or capability to actually reproduce.
I'm also learning today that apparently people are sticklers about the usage of the term "binary". I use (and assumed most people would in this context) binary to mean "a set of two different things". It doesn't need to be more complex than that.
The varying combination of chromosomes or physical traits or whatever-else-have-you do not change the nature of sexual reproduction. I would dignify humans as a non-binary sex species if intersex individuals were not just, in this context, some combination of male and female.
My reliance on sexual reproduction is not dependent on an individuals capacity or willingness to actually reproduce. It is an assessment that, as a species, we reproduce sexually via elements from two sexes. Intersex does not add a new element to this.
In this specific context those exceptions (intersex people) are individuals with some mixture of both male and female. That does not, in my eye, constitute a distinct third sex especially with regards to sexual reproduction.
I'd rather you not assume that my personal stance regarding sex and its practical applications stems from a place of discomfort. I am also quite vehemently -against- any policy that would exclude, demonize or dehumanize "those 1-2% edge cases".
Because I'm not making a statement about an individual's sex being reliant on their active capacity to reproduce. The concept of reproduction involving parts from a male and a female does not that people who can't or don't reproduce are neither.
Good thing we're not talking about those things then, are we.

If I were relying on chromosomes you might have a point. My personal stance stems from reproduction. A provides sperm, B provides egg, this results in offspring. Humans do not have some distinct "C" relating to this process.
You are being a pedant about this. That or you are incapable of applying the concept of a binary to abstracts. It's also possible you're fixated on binary as a noun rather than it's use as an adjective in regards to sex.
This is the entirety of why I say humans are a binary when it comes to sex. There isn't some third sex involved in the process of reproduction. The incidence of individuals, by birth or accident, who have lost some capability to perform a sexual role is irrelevant to this.
So far as I'm aware sex is determined by a species method of reproduction. With humans the male provides sperm to the egg produced by the female and that produces new humans. Intersex individuals are a combination of traits from male and female, not a new set of traits.
There is A and there is B. The only other option is some mix of A & B and given that's an incidence rate of not even 2% I don't think it's statistically significant enough to declare humans are not a sexual binary. Not for practical purposes.
It is also important to note that the biology of the sexes is primarily only relevant for the sake of medical and scientific reference. Outside of that gender is more relevant for common purposes.
Gender is a spectrum based on personal experience and expression. I accept that despite the parts I don't and can't understand. However the small incidence of intersex individuals, of which most are primarily male or female, does not create a significant exception.
That's not how it works. The human sexes are a binary in that they are divided into male and female. I think part of the issue with the stance you're expressing here is that it blends sex and gender together when those two concepts have been different for a long time now.
I'll reiterate that you should just embrace your bigotry instead of trying to hide it by talking about biology or trying to speak on behalf of women about what they want. You seem to just want to oppress a small group of people purely because it's "okay" to do so.
