Are such checks — beyond something like the Constitution — even possible on any top-level deliberative human-based system like the SCOTUS? I can’t think of any that isn’t problematic in that sense. Bias is a human problem, not a SCOTUS problem, I believe.

It may prove the only available path, to be sure, but if I read correctly Ms. Parker’s original post, she’s not asking us to load our muskets just yet. She is stating what would be necessary in a Dem candidate to warrant her vote. I myself would dread voting for a horrible candidate like Newsom…

I see. I don’t understand how the problem of the SCOTUS goes beyond its current composition. Had it always been problematic? How is it problematic beyond a conservative/transactional majority? In what sense should it be reformed (and how to achieve such reforms)?

Is there a way to “heavily modify” the Supreme Court without a majority in said Supreme Court and a 2/3 majority in Congress and the Senate? I can see only one: revolution. Is that what you’re proposing?

Also: how would that be easier than keeping voting for progressives — however flawed they are — until the imbalance is reversed? Would a revolution — in essence what you are proposing, if I understand you right — be easier to achieve than the necessary change?

I’m sorry, am I getting this right? is your solution to the current Supreme Court imbalance to abolish the main branch of the judicial system? The one responsible for upholding the Constitution? I’m not trying to be confrontational. I am genuinely confused: how would that help to fix Democracy?

As much as many Democrats, like Newsom are flawed, the risk of having the next president appointing Supreme Court Justices of the caliber of the right wing majority that constitute today's Supreme Court is too high, I believe.

Comparing that to Biden -- a far from perfect defender of transgender rights -- we have a different outcome He appointed justice Ketanji Brown Jackson to the Supreme Court, a much more progressive justice, that even if not ideal, is far, far, FAR better than any of the three above.

My only qualm with "Never Newsom" is this: presidentes last 4 to 8 years, and as consequential as they are, aren't as consequential as the Supreme Court Judges they appoint, I believe.

I agree that Newsom has been acting in detrimento of trans people's rights for a long time -- adn for strictly political reasons, utterly devoid of principles -- and is far from an ideal (or even acceptable) candidate in that regard (and many others).
