True story: I haven't agreed to my Samsung Galaxy phone's updated terms of service in two years (I just swipe it away), and in consequence Galaxy AI has always been deactivated on my phone. I feel pretty good about that.

I do the same thing, I've been wondering how long they'll let me get away with that
We're probably at a weird intersection of laws regarding when and how they can cut off service to a user who doesn't agree to new terms and when they would face liability for something the new terms of service agrees to waive or send to an arbitration in Malaysia.
Interesting that they seem to not activate it just because you don't agree to the TOS. I do wonder if they actually "disable" it though, considering all of tech is stuffing AI into every part of their infrastructure. I haven't updated to Android 16 because Google's Gemini gets shoved into all apps.
Regardless of whether you agree to those terms, allow Gemini to be installed, or whether you have Gemini Apps Activity on or off. It's not even clear if you CAN remove Gemini. arstechnica.com/security/202...
I should probably stop being lazy and just replace Android with GrapheneOS or something similar.
I have all mine disabled. It's annoying as I'll get out
