NEW: This morning, DOJ's Drew Ensign confirmed that the last of 76 children the Trump administration tried to put on planes & send to Guatemala in the middle of the holiday weekend are back in the custody of the Office of Refugee Resettlement, the result of a well-timed lawsuit & fast-moving judge.

FIFTH STATUS REPORT Defendants hereby provide notice that that final minor alien of the four mentioned in the fourth status report was returned to ORR custody at approximately 1:30am EDT. The other alien mentioned in the fourth status report was also placed in ORR custody today. Defendants are not aware of any other putative class members that have not been returned to ORR custody. Respectfully submitted this September 1, 2025. s/ Drew C. Ensign DREW C. ENSIGN Deputy Assistant Attorney General Civil Division, Office of Immigration Litigation

So the judge ordered the kidnapped children to be left in the hands of henchmen of the criminal puppet regime. This is exactly what I mean when I say that courts, judges, the Dems and the flying Spaghetti monster will not remove the puppet regime FOR you people.

Great outcome given the circumstances. Pretty depressing that Sooknanan was so (rightfully) skeptical of the DOJ’s doing the right thing that she required five status reports.

Yes. None of those planes I was tracking were shown to be carrying minors.

Oh, thanks. I assumed they were deportation flights. They could have been cargo or passenger charters?

They are all deportation flights. The minors in question were removed from the planes yesterday afternoon.

Might anyone know if the children were initially in foster homes or other arrangements but are now in a shelter? And do their attorneys have access to them to make certain they are in a safe environment?

"Defendants are not aware of any other ..." Such bullshit can not be trusted. He can not say explicitly that all children have definitely been returned to ORR, so he claims ignorance.

I don't know the inner workings but the advocacy group that brought the lawsuit must have had inside information.

This judge and her staff are badass. They worked almost 24 hours straight to make sure these childrens' rights were protected.

Does this carefully worded confirmation mean that they've gone to the trouble of returning only four children? Are there 196 children who they're still moving because they feel like the judge's orders don't apply to them?

What are you talking about. I said "the last of the 76" — meaning the other 72 already had been returned. (Maybe you should read the thread from yesterday, which I provided, if you had a question.)

I get it, truly, but I also provide the information for a reason (and word things carefully). If there was such a ridiculous move from the administration, that would have been in my post.

Every single person involved - agents, pilots, crews, airlines, anyone who saw or signed the order - should be in jail for life. It violates EVERY law we have about reporting potential child endangerment or participation in child endangerment. There is no immunity this barbaric and dangerous shite.

I'll be covering this and more at Law Dork today: www.lawdork.com Fifth status report: storage.courtlistener.com/recap/gov.us... In the meantime, here's my thread of Sunday's developments:

Yeah, I'd wondered about this. Judge Sooknanan asks the plaintiffs why they didn't file the status report that she had ordered them to file.

MINUTE ORDER: The Court ordered the Plaintiffs to file a status report by August 31, 2025, at 6:30 PM. They have not done so. The Court ORDERS the Plaintiffs to show cause why a status report was not filed by that deadline. The Plaintiffs remain under their obligation to file a status report addressing their understanding of whether the putative class members have been deplaned and returned to ORR. Signed by Judge Sparkle L. Sooknanan on 9/1/2025. (Icak)

Different status report and show cause. I lost track too. Ensign explained why he missed the 4:00pm deadline. Not the 6:30pm deadline. So Judge ordered Ensign to show cause

So essentially she's ordering counsel for the children to confirm that the .gov actually followed the original order? One presumes they're going to say something like we were unable to answer your request in a timely manner because the .gov was stonewalling..?

Yes, and, I want to know why the kids on the plane were returned in dribs and drabs, instead of all at once. The latest, apparently, not until 1:30 am. Why the delays? Maybe the lawyers will add more to the unknowns.

Elf Herself @elfherself.bsky.social

Potentially they were on multiple planes? Or, potentially returned all at once but paperwork/supporting info was delivered in clusters. (Less-friendly option: They were trying to figure out which kids might be exempt from the ruling and hoping to deport some.)
