If you not state that you're "ICE" or wear any insignia that states that you're "ICE" (or any other organization), you're simply another person in a mask.

That won't carry the day in court. The prosecutor is going to say that the reasonable person would have presumed you were an ICE agent. And that you were interfering with an ICE operation.

And that opens up the argument that no reasonable person can be expected to know who is an ICE agent or not, therefore no reasonable person could know what clothing to wear or actions to take to ensure they avoid that assumption. This would then force them to define parameters in the future.
