And contrary to widespread belief, if you say under oath that you don’t remember something that you do, in fact, remember, that’s still perjury.
And contrary to widespread belief, if you say under oath that you don’t remember something that you do, in fact, remember, that’s still perjury.
"I do not recawl" is the longtime mantra of the MAGA nominees. From Jeff Seesions to Bovi. Liars and crooks all.
My memory is spotty on the exact phrase and who said it, but I believe Nixon’s people liked to say, “I fail to recollect.” H R Haldeman still went to jail for perjury.
That was waaay back when there was a degree or two of integrity. Sad.
Marjorie Taylor Greene belongs in the hall of fame for that one. She wasn't even trying to fake "not recalling." She just spouted out "I don't recall" or "I don't remember" to every single question. Pathetic.
There are memory care homes that are more appropriate than Congress or certainly the federal judiciary.
Right! If your recall/memory is 100% dysfunctional, it tells us a lot about your mental abilities…and you have no business being in the business of making laws for the rest of us. 😡
Since it didn’t happen long ago, it would seem that this man is unfit for such a position if he can’t remember something so many of the witnesses do in the same timeline.
The very next question after Bove answered should have been do you recall not saying that
If only that were actually true.
How do you prove a memory?
The Trump Administration does not care. They lie with impunity. They watched Donald break every law in existence AND become President. They obviously believe in trickle down Presidential Immunity.
Especially.. that he has full recall for what he said the day before. “I do not recall”, it’s a cheap answer, but highly disqualifying for someone seeking a lifetime appointment on the highest judicial offices in our country.
I think it’s time that you actually swear them in before testifying ILO of having to prove they lied after the fact. This way they can’t say I do not recall. They would have to plead the fifth amendment. Who’s knows they might just break Trumps record.
How can you prove it, though?
Serious question: in all of your experience, have you ever seen a person convicted of perjury for lying that he or she did not remember something?
But how do you prove that someone didn’t forget?
But that would mean Trump’s Cabinet is screwed when the DC Trials begin when this hell is over…
I believe there are not many people that think he did not say it and trust he does not remember. It's all too obvious. He's toast.
Does he have a drinking problem?
A reason for impeachment and arrest in a honest administration.
Nosferatu lives
Hopefully someone has a recording
Sounded a lot like Iran Contra hearings in the 1980s.
So no backsies on the "I think I don't remember" defense?
But if you don’t remember your perjury it’s all good, right?
Perjury is second nature to these people
He may not completely recall. He may think it's possible he said it, so can't say no, but doesn't directly remember, so cant say yes. Schiff emphasizes the "fuck you", but the tone may not been as aggressive, and not nessesarily memorable. Don't ask me what I said at a meeting last week.
Indeed, but the problem in this country now seems to be that even after clearly, obviously breaking the law, there is no consequence. At any level.
“if you say under oath that you don’t remember something that you do, in fact, remember, that’s still perjury.”… I think Bondi today saying she didn’t know that ICE agents were masked but then later made a statement that she knew they were was evidence of perjury too. bsky.app/profile/atru...
When you give a trump a cookie..
It seems memory loss is a common affliction among rabid republicans. “Under questioning, Marjorie Taylor Greene has to be shown the language of the oath she took, because she can’t recall if she said she took on the obligations of office freely & without any purpose of evasion.” -Joyce Alene
And if a person doesn't "recall" something of great importance, then they are not suitable for the job.
Who might be in charge of prosecuting a perjury charge referred to them by Congress? Pam Bondi? Good luck
Guess there's no choice but to accept the word of a person who does remember.
Yes, but I imagine its hard to prove that someone does remember something.
Isn't the reason lawyers tell people to not remember things because you can't technically prove whether they did or didn't remember it in the moment?
Bove is creepier than Miller.
Damn hard to prove, though. We all believe he really said it but possesses insufficient balls to own it.
Yes, but the worst part about the whole thing is he’s just lying his ass off like the rest of tacos, administration, and nobody is going to do anything about it.
How does one prove that?
And to put it even more simply, if you genuinely did not remember, you would say you didn't say it. If you don't remember saying something you would say you didn't say it...
bsky.app/profile/adam...
Try proving that in court.
I dont think the word holds any meaning anymore. It's not a threat. Not to these people.
Yes but it's unprovable. So my proposal is we pass a lie detector test for anybody testifying in Congress after they have testified to see if they lie and if they have send them straight to jail. Won't that be a great law??
Its not unprovable, but I would think it would be pretty hard to prove. Lie detector tests are not reliable.
Psychopaths and sociopaths tend to ace lie detector tests. They don't get nervous when lying. It's their way of life.
Okay but it would be better than we have now where all of the administration secretaries are lying through their teeth every time they come into Congress. Somehow we got to figure out a way to keep this from happening. And it goes for any administration!!
Great TV viewing, too. Very bigly ratings!
Yes it is perjury. But so did Pam Bondi and Pete. They’re all just a bunch of damn liars. They are lying for their lives because if they don’t they’ll be locked up for treason.
Refusal to admit what is documented and known is tantamount to a lie. Lies are perjury.
just part of the job for these clowns
In English, what would a court require as evidence that someone remembered something when they stated under oath that they 'didn't recall'? Written evidence like emails that mention the incident after the fact?
Doesn’t matter what it’s called if there are no consequences for it.
Who could tell, tho? 🧐😬
Oh Lordy. Maybe there’s a tape!
When is the last time any of these motherfuckers got charged with perjury? Exactly.
Another horrible pic by Trump
Here is why he may be lying: Kavanaugh Coney Barrett Kennedy Jr Noem Bondi Hegseth All these people lied or were evasive under oath to the Senate as to what they would or would not do, despite all signs and actions showing who they were. They were still confirmed. Senate suckers.
They’re not suckers, the Republicans just don’t care.
But whose going to prosecute him?
Who's dammit!
I would say lock him up, but we already know that there will be no consequences so, whatever…🤷🏻♀️
This is the man who trump initially assigned to Cassidy Hutchinson. He told her to lie under oath saying she didn't know facts that she in fact did know. The Republicans gave him an award. www.rnla.org/rnla_honors_...
Oh, yea.. those laws n rules things don’t apply to this gang
Bove:
Prove it.
Ask Ollie North how effective that was for him.
Isn't it supremely difficult to prove perjury when it comes to claims of memory? That's why they do it?
Don't recall the legacy of Jeff Sessions that continues to live on. That and Weirdo Miller.
Aah, but he didn’t TELL them to say it, he told them they OUGHT to say it. Just the kind of weaseling that qualifies him for our higher courts now.
Agree.
Senators do NOT confirm Bove Remember your horrible confirmation of Pam Bondi RFK Jr Pete drunk Hegseth @schiff.senate.gov @gallego.senate.gov @sanders.senate.gov @wyden.senate.gov @booker.senate.gov @captmarkkelly.bsky.social @vanhollen.senate.gov @whitehouse.senate.gov
exactly x.com/RichardClip/...
The “I don’t recall” line is used frequently (remember sh*t hole countries comment). Their lawyers construct a definition of “recall” that is different from “remember.” My guess: They, of course, remember a remark but choose not to actively “recall” it.
But when you deny, you know the person you’re saying it for (Trump 2.0) will remember that and beep you in his inner circle.
www.judiciary.senate.gov/imo/media/do... Read the DoJ whistleblower letter for yourself. Feel free to share.
Fdt terrorists
So it's obviously disqualifying having lied under oath to Congress.
And if you maintain you don’t remember, that is evidence of a disqualifying cognitive impairment
So what do we do about their obvious lies and obfuscation as our democracy implodes? There is no enforcement of the law (let alone “norms”), there are no consequences and zero contingencies for what’s happening with these people who are running rampant.
Not a chance he doesn’t remember that
It worked nicely for Reagan.
the Trump crime family perjures itself every day. nothing is done. what does the law matter if we won't enforce it? legal theater, nothing more. we aren't a nation of law anymore. we're run by a transnational crime family. we're an autocracy.
Oligarchy actually. But the effective difference is zero.
you're probably right.
Yes but who would be the ones who would charge him? Oh yeah. Trump’s DOJ. Likelihood of that? Not a chance they’d do that since he is lying for Trump.
If he has such a feeble memory, perhaps he should not be confirmed to a lifetime appointment as a judge
The hearings are a waste of time and dollars unless I suppose, for the record, these people will ultimately be brought up on charges.
MTG got away with it.
TRUMP does not remember if he has to follow the Constitution. New Republican defense is willful ignorance!
The burden of proof is pretty steep. It would be hard to prove that really remember what I tell you I don’t.
And that matters why? Like we have ever gone after anybody for lying to congress - well at least the justices, reps or senators, presidents, etc.
as was pointed out during questioning, the likely reason is he makes such statements regularly
THIS. I tell everyone I am deposing that they can always say "I don't know" or "I don't remember" if it's true--it's just as useful to know what a deponent doesn't know as what they do know. But if you know, you are required to answer truthfully. If you don't, it's perjury.
Schiff should’ve concluded: “regrettably, we therefore must let the historical show Emile Bove either uses profanity so much that cannot remember recently saying ‘fuck the court’ or he’s lying to the United States of America.
But how do you prove that he remembered it today? Even if he comes and says a week from now “oh yeah, I remember that“, that doesn’t mean he remembered it today. Not defending that rotting carcass of a person. Just seems hard to prove, however.
And in situations such as this, when an important statement of personal intent is at issue, most juries also reasonably find that “I don’t remember” means “probably, but i cant say for sure that I said exactly that at that precise moment, because i dont want to. “
I hope those people come forward to testify
Republicans are gonna lie cheat & steal. It’s what they do,It’s all they do. They only people that don’t know this, or pretend not to know, is other republicans. the uneducated, this was Trumps own words. His people are the uneducated, his favorite people. The ones even someone dumb as him can con!
Does it matter? We all know the Republicans are going to approve him anyway. He could be a literal murderer and they’d still be like ‘well, Trump wants him so 🤷♂️’.
Lordy, I hope there are tapes!
What? ..is their some law or Senate decorum that says you can't bring in someone to rebut what this guy is saying?.. or do we all just mumble that we know he said it and then just move on..
Please, it can be whatever you want if there are never any consequences.
prove it
When was the last time a lying liar who lied in a Congressional hearing was convicted for perjury? Haldeman and Mitchell of Watergate infamy in 1975. All the other cases since then were dismissed or defendant acquitted.
Why do they let these assholes lie and do nothing about it?
Emil Bove lied under oath. Evil.
It’s proving that he remembers that’s the difficult bit. We know he does. He knows we know he does. But he’s confident we can’t prove it. 🤷🏼♀️
Is actions show his words.
Thank you… HE IS STILL LYING…
Blanche supported Bove when he knew that Bove would likely be asked about this before Congress. Instead of mapping out beforehand how things would go, Blanche spouted off & then was left hung out to dry when Bove had to say that he didn't remember. When they aren't lying, they are quite stupid.
And how is it proved?
How do these people imagine, in their optimal imagining of the outcome of all of this, that they won’t eventually face accountability for their criminality? He dies, they’re fucked.
definitely
Not for Republicans! just saying
I find these meetings really lack any purpose. The Republicans all just lie with impunity and no one is there to enforce perjury charges. It's just a performance which has zero consequence.
When you listen to him talk, he is frightening— like Stephen Miller.
Exactly! Both of them are like The Walking Dead.
Yeah, but how do you prove that someone remembered something they say they don’t remember.
I imagine you prove it, if they said something to someone maybe a few days earlier. It makes it hard to believe that a person would forget something that recent.
And then they can go to all of the appearances made by his team backing it up because every filing was an fu
You can’t expect a potential federal judge to know them fancy legal words like “perjury”
This is not going to end until one of these Trump flunkies gets held in contempt and sees themselves in a holding cell.
Welcome aboard the Reagan dementia "I don't recall" railroad.
Obvs.
Perjury lost all its teeth when Jeff Sessions, caught lying at his hearing, was allowed to write a letter CHANGING WHAT HE SAID.
I’ve testified many times and have often pondered the phrase “…the whole truth…”.
Congress is, in trump’s own lingo, a shithole where the respect and obedience to laws are a thing of the past.
The farther in the past it is the harder it is to know if you really remember it. You might remember generally but the answer to whether you remember something specific might very well be no even if you think it likely happened.
I would imagine that's awfully difficult to prove though.(??)
Every time one of these assholes says they don’t recall you know they fucking do.
The question is: how could that EVER be proven?? 😟 This has become a widely abused tactic (how many times has Trump said it in his depositions? 🤨)…but can anything be done to prevent it?
Yup . He was lying.
True. But when has anyone who’s lied under oath to Congress ever been prosecuted?
But, who, if anyone, will enforce this?
he completely fucked up when he insisted he didn't recall doing it...then moments later said he "did. not." do it.
It doesn’t matter anymore what anyone believes. Thune is deaf and/or doesn’t care, would kiss anyone’s a$$ to be “leader”. Johnson is a blushing sycophantic clown. They aren’t heroes they’re cowards with the power to save the country but won’t. These dishonorable miscreants all betrayed their oaths.
But if right now I say I don’t recall reading the above post by George, how can you prove me wrong? People have memory problems, don’t they? (I despise Bove, but I’m just wondering about the “don’t recall” strategy.)
How many of Trump's cabinet secretaries lied under oath during their confirmation hearings?
And the not so Supreme Court who suddenly couldn’t remember what they said under oath before confirmation
Doubt there’s much of a record of perjury convictions based on a showing the witness actually recalled what they said they didn’t. Besides, nominees lie to senators all the time without consequence.
so bring perjury charges! today! otherwise this is a distraction. these people will do what they want because nobody will stop them
The GOP method of taking the fifth without actually taking the fifth, in the hope that they won't get caught lying to the judge.
Anyone have it on tape? That would be nice?
Can’t they block this POS?
And if Republicans weren't all cowed dumbshits, it might matter.
ANY RATIONAL PERSON would CERTAINLY RECALL TELLING SOMEONE TO F*** someone…We REMEMBER THAT! It is offensive to look at someone (with cameras rolling and being broadcast to the American people) and FLAT-OUT LIE to us or think we are stupid! He’s WRONG! We remember! Do they EVER get tired of LYING?
WHEN wil these liars start being prosecuted for perjury?
Let's say, just for fun, he can't recall significant and recent legal positions he's taken-- It's a disqualifier for a judge position!
American lawyers have been officially outed....just money grubbing liars.
It would be nice if a Dem legal scholar would have added something to the effect of your comment to the record as a point of …sunshine. Markers of this sort might lessen media mischief or spawn useful discussion on the point at hand.
It's just really really difficult to prove that you actually did remember it, i.e. that you were lying.
