Those who say they already ruled that presidents regardless of party have immunity. They did not rule that, the majority ruling decision gave them ample room to decide which presidents get immunity and which don't because those in majority believe they will hold away for decades.
One of the things people fear is they will see court ruling in complete opposite way depending on whose president. In other words they will say repub president has immunity for a certain actions and then turn around rule dem president does not have immunity for same action.
