Can we stop to talk about how remarkable the timing was? Compliant at 1am, Judge engaged at 2am, ex parte call to the Government at 2:30am (they did not answer), TRO at 4am? On a Sunday of a holiday weekend?!

That's judicial action by a real judge. WOW...

Good to know some small part of our system is still trying to stop this shit show of a circus. 🎪

@schnorkles.bsky.social - this admin has used up all their goodwill in cases of immigration - esp deportation of CHILDREN as young as 10
What happens if the child stealers don't comply? Who will hold them accountable?
Given that they (probably) turned around a plane in the air this morning, I don't think functional noncompliance is a real issue here. As for administrative noncompliance, a likely explanation remains that DOJ did not receive the first posthearing order (because no appearance was filed).
You don't know what they did. Their history is to lie to the court so I suspect they did not turn anything around.
Also the amount of hours it’s taken them to get these kids back would indicate you may be correct.
I’d be surprised if they were lying about this. They tell a certain kind of lie all the time - we misunderstood your order, it wasn’t in writing so didn’t count, we have no jurisdiction over that… they don’t usually lie about easily proven facts.
They lied to Judge Boasberg in the DC D.C. as to whether the plane to Venezuela was beyond US jurisdiction. That's why he held a hearing just last week on whether to hold the gov't in contempt of court.
While looking up this older case I discovered that the US may now be at war with Venezuela
Isn’t this the same case where the government lawyers said the order should have been in writing?
Pronouns are tricky here. Today's case, L.G.M.L. v. Noem was filed at 1:02am TODAY, Aug. 31, and is (now) before Judge Sooknanan. That is not the same as J.G.G., the case before Judge Boasberg, that is the subject of contempt proceedings now stayed by the en banc DC Circuit. So: No. [fixed typo]
This just in: bsky.app/profile/josh...
That’s too generous based on their clear and obvious track record.
they underestimate the diligence of the opposition
Also: Anyone on here with access to the Mailings menu in ecf.dcd (cgi-bin/MailNoticeRpt.pl)? Do we know if Drew Ensign is signed up to receive notice of the 4pm status report deadline that was just missed, given that he has not filed an appearance?
"Because Defendants had not yet entered an appearance, they had not received notice of this Court’s order requiring a status report by 4:00pm and thus were not aware of it." Oops
Can we stop to ask why the pedophile regime is moving unaccompanied children around in the middle of the night?
1 hour later...no 4pm status report. Doesn't anyone with a filing account have that menu?
Starting to get a bad feeling about this.
They're ignoring the court order, aren't they.
I guess she's read the J.G.G vs Trump case file VERY CAREFULLY. Also, I'm quite sure Judge Boasberg is waiting on that en banc rehearing to add the government's behavior in this case to his list of exhibits.
TY
I had to look her up, since I’m not familiar with all the various judges, but there is good in this world and good in immigration, which has given us Judge Sooknanan!
Normally it's not worth commenting on notices of appearances, but…today it is. Drew Ensign files his appearance in the case at 6:20pm, so he will definitely receive notices going forward and can be presumed to have read the docket and prior orders by now.
Well, apparently they claim to have not received notice of the order due to non-appearance. I wonder how things will change in the future.
It's maybe worth noting this is not the first time Deputy Assistant Attorney General Drew C. Ensign's failure to enter a formal appearance in a case has drawn attention. In the D.V.D. litigation before Judge Murphy (D. Mass), plaintiffs objected to his arguing w/o appearing. No dodged orders, tho.
Ooops? At 5:19pm Sunday, Judge Sooknanan, in the midst of all this with the Government's status reports, ordered Plaintiffs to file a status report by 6:30pm Sunday. I missed that, and it appears the Plaintiffs might have, too, because they didn't. Sooknanan Monday at 12:07pm wants to know why:
Like me, Plaintiffs didn't read Judge Sooknanan's order carefully, they say ("overlooked"). Plaintiffs now do not disagree with the Government's assessment that "all putative class members transported from ORR facilities have been deplaned and returned to ORR custody."
If there’s never any penalty he can do whatever the f he wants.
Every day another excuse Every day another feeble judge who lets them get away with it.
Judges are like bad parents. 1. Do this by 4 or you’ll be in big trouble! 2. Why didn’t you do this mister? 3. You better come up with a bs excuse! 4. Ok. But you better do it by tomorrow or you’re in BIG trouble No wonder no one is scared of them.
