That is an extraordinary step, and before it can step in, the Court must conclude that the plaintiffs are likely to succeed on their claims, that they would suffer irreparable harm in the meantime if the Court lets the lawsuit run its course, and that an injunction would be in the public interest.

The Court does not need to find, and it is not inclined to find, that Martinez intentionally lied. His second declaration and his sworn live testimony during the hearing acknowledged the truth of what the plaintiffs' witnesses were saying, and once on the stand, he freely admitted what he did not know. At times, he appeared anguished by both the demise of the agency and by his being cast in the role of agency spokesman; there were multiple painful pauses when you could see the battle between his conflicting loyalties to his new employers and to the truth playing out on his face, and he grimaced or turned red before he answered. He had the demeanor of an abused wife brought to court by her husband to drop the charges.

The DOGE folks told the court everybody was still working at CPFB. Meanwhile, they told everyone to stop working, and even set up a snitch line for banks to let DOGE know if any rogue employee was actually trying to do their job.

Yup. I've been making that comparison re the Republican Party in general since pre-Trump. Gaslighting, belittling, threats, emotional volatility, demanding financial control, "look what you made me do", etc, etc. Trump just ramped it all up.

Oh not stretching it at all. At least one other poster I've seen in recent days specifically mentioned isolating us as another abuser tactic. We're the spouse who got away and then went back, and we might end up dead if things continue.

The "abused wife" reference had me laughing out loud and saying "omg, omg." After 5 decades of reading court opinions, I know how rare that kind of sentence and that opening are. But right now such stark language is critical.

This is an excellent account of why judges should be requiring live testimony under oath, not just affidavits, much less relying on representations by DOJ counsel (who obviously know little of actual facts). Being able to observe demeanor is crucial.
