In this particular case, I'm not sure about that. They'd have to ignore their own words from just a few months ago in Trump v Wilcox.
And this would be a problem for the Supreme Court how? They’ve ditched all pretense of not being a rubber stamp for the president. You don’t even see Stephens moaning about maintaining the legitimacy of the court anymore. They have one job and that is protecting Trump.
They don't seem to have any problem undoing the decisions of older courts, but this is their own ruling. That's gotta be tough, even for them.
If they had any integrity left it might sting.
As long as Trump declares it is an official act it can’t be illegal anyway. The court already declared that he is above the law, there is no reason for them to change course now. It’s too late anyway.
