It's not easy to do without making it easy for GOP to do opposite Dems can't codify a right without an exception in filibuster. Otherwise, it takes 60 votes to pass legislation in Senate If there is a filibuster exception for that right, danger is GOP could codify opposite with 51 votes in Senate

This entire thread is a list of things for which you would never have enough votes to pass laws. They can only really be passed at the state level. And maybe if you can get enough states to agree, you could do an update to the constitution eventually. But that's unlikely. So state level is max.

Fundamentally, while the right and left refuse to figure out how to get along... They're both just going to sabotage anything the other side pushes. Plus, currently, Republicans have majority in Congress and Senate (as well as the Supreme Court... nonsensical as that should be)
