Sorry to nitpick but you mean article i courts? I think the problem here is less with immigration court being run by an ALJ and more our immigration laws just being really bad.
You’re right, typo. But no, I genuinely think it’s bad that cases are adjudicated by “judges” who can be fired by the attorney general. I mean, they have quotas!
My experience is state/local but I was under the assumption federal ALJs had for cause protections but if that’s not literally or practically the case, yeah I agree that’s bad. Not that for cause protections mean much anymore, smh.
I do think the perks of administrative proceedings (relaxed evidentiary rules, subject matter expertise, speed, etc) make them better than article 3 courts for lots technical and bureaucratic disputes, but some kind of removal protection for ALJs is necessary.
