And is their “move the defendant” shell game the only thing thwarting a habeas petition or a 42 U.S.C. § 1983 suit? Or is there another reason?

I think it’s even sleazier than a “move the defendant” shell game. They don’t have to move these people, the feds and the state just have to each disclaim responsibility for the prisoners long enough to put them on a plane out of the country.
