Assuming this isn't within 100 miles of the border (which technically would be the ocean, I guess), and absent reasonable articulable suspicion, ICE has no lawful basis to stop cars and ask for proof of citizenship.

"Am I being detained? Am I free to go?" Is all that you say in this situation.
If they approach you, get out your camera, start recording, and politely tell them to fuck off!
We are a completely lawless society. Thank you Justice Roberts, Mitch McConnell and the sycophants in the GOP for letting Trump destroy democracy.
So what Would be the appropriate and legal response for a driver to give in a situation like this?
How are you supposed to prove that you are a citizen of the US? How would the office prove that he is a USC? Are USCs now required to carry their birth certificates or passports at all time?
There isn’t any part of Florida that isn’t within 100 miles of the ocean or the Gulf of Mexico.
Remember! DHS/ICE is Trump's personal ARMY. Guaranteed expanded through the Big Abomination Bill -- wholly supported by "Republicans", his own organization of Political Officers loyal only to him. I repeat: a national ARMED FORCE loyal only to Trump, untouchable by law enforcement, is coming.
This type of thing reminds me of WW2 movies. People are always being stopped and asked for their “papers” and you’re terrified for the person being asked.
Sadly, there is no place in Florida that isn't within 100 miles of the "border" (ocean).
They're bounty hunters.
But yet no one is stopping them.
Well, they’ve been in Sacramento which is over 400 miles from the border… No rules seem to apply
Essentially all of Florida is within 100 miles of a border. I'd bet over 90% of the state population falls within their jurisdiction.
www.newschannel5.com/news/newscha...
What about a dui checkpoint run by the local police and with ICE hovering nearby and picking off anyone they want
apnews.com/article/immi...
This is Trump's America - He thinks we don't have rights while he is in office - Tick tick Trump, Tick toc -
I think their range has been expanded, they are not limited to 100 miles from the border anymore
Do people need to begin carrying their birth certificates? Passports? What "document" will qualify?
Make sure to have your parents’ birth certs too
Florida is a "stand your ground" state and lots of people carry guns, ICE is just begging for a confrontation.
Racial profiling
Is there any place in Florida that is NOT within 100 miles of the "border" because its surrounded by the ocean?
Apparently no
Others have made the point (you may have been one; I cannot remember) that a very large portion of the US population lives close to the border because we are a mercantile society and it makes sense to live close to shipping hubs.
Also: conveniently unmasked!
wtf
All of Florida is within 100 miles of the border. Explainer: www.aclu.org/know-your-ri...
www.aclu.org/know-your-ri... It doesn't say anything about stopping cars.
⅔ of the U.S. population lives within that 100 mile range. www.bloomberg.com/news/article...
thank you for the gift link
Don't forget: The Mafia doesn't care about the law. & if anyone thinks I'm exaggerating, ICE are now IN SERVICE OF A REAL MAFIA. Because Donald Trump is a real mob boss, and has been so his entire adult life. Oh, & Epstein didn't kill himself. & there's no tape because that's how the Mafia works.
“Lawful basis?” In Florida? What a curious idea…
Many decades ago as a young driver in the Commonwealth of Virginia, police would routinely have traffic stops to check drivers' licenses, that is until they couldn't. I can't remember the date or case, but I'm pretty sure it was before 2000.
And they must be really desperate and scraping at the bottom of the barrel trying to find illegal immigrants. I guess the agriculture industry is off limits
Go fuck yourself would be the appropriate response. And I’m a retired police.
These ice people have no honor, where is their dignity
This dictator regime is planning to stay in power aren't they? We're fucked.
Most of the US population lives within 100 miles of the borders/ocean....alas..
pretty much all FL is in the 100 mile zone unf
Is there any part that isn’t?
No www.aclu.org/news/immigra...
This map is incorrect. It uses the coastline, not the international border. On the coast, the international border is 12 naut miles offshore www.law.cornell.edu/cfr/text/8/2...
The widest part of Florida is 150 miles across. Include the international borders and thats 174 miles. Only problem is, the border is on both sides of you. The 100 mile rule for ICE is dumb, should be unconstitutional, and needs to be repealed if we ever get the chance again.
FL is hosed unless the law is changed. The ACLU used a map from a Bloomberg article which used a he US coastline (blue dash). CFR 287(a) defines the 100 mile zone from the US External Boundary (I plotted in red). My map shows a smaller area. www.bloomberg.com/news/article...
Also also, damn good map. Nicely done.
Im 100% in favor of the 12 Mile rule as that means my house is not within it. Alas I doubt that this regime cares about these things. And yeah, that ACLU map is an extreme exaggeration.
I looked for, and could not find, a map on the CBP website. I’m sure they were delighted when the incorrect map was published.
Allowing that agency to accumulate unchecked power was a terrible mistake of the past 20+ years.
It is depressing that all of Chicago falls into that border zone, and pretty much every major city that isn’t like, Denver
Yes but it's also important to remember that this isn't new; it's been this way for a long time and because of that it can now be abused Not said here is what happens if you're a citizen but suspected of being an immigrant (hint: double not good)
I now Cincinnati isn’t either, but I did say major city. :)
Just effing no
They treat all of Ohio within 100 miles of the Lake Erie shoreline as within 100 miles of the border even thought that is clearly BS. From a map I notice someone else posted in reply to you, it appears they do that even with "interior" portions of the GLs.
They don’t currently but as soon as a case gets to the Supreme Court they will.
Isn’t Floriduh a stand your ground state? Stand your ground!!
WTF this is absolutely insane .
Not nearly enough Americans are horrified by this and the fact that it seems to be excellerating 🫣🤯😱🤡☠️
Speaking of horrified, I slaughtered the spelling of " accelerating " 😖🤦🏻♂️🤦🏻♂️🤦🏻♂️😂
Look at all those cities those thugs can terrorize.
And 2/3 Americans live in the red part.
Being as I live in the Great Lakes region in Cleveland, note how they treat that. Chicago is clearly like 500 miles or something from what is shows is the Canadian border, yet they have it and 100 miles inland as border.
Apparently the issue is the border enforcement zone measures land not water. I wouldn't be surprised if it gets challenged in court if it hasn't already.
www.aclu.org/know-your-ri...
It also is worth noting that this includes international airports. It is possible to be right in the middle of the continent and still be a few miles from the border because airports count as the border.
So that picks up cities of almost any real size because they will have at least one flight from Canada, Mexico or the Caribbean, what many people wouldn't think makes an international airport.
Bingo. I read an article about this recently that boiled down to "if you think you are safe from border patrol, you're not." Them having jurisdiction within a distance of international airports was the primary reason.
I have long been amazed it has not. It is obviously total BS the way they interpret the border.
Agree. that is probably wrong but the coastal states have a large area.
Uhh, the entire State of Florida is within 100 miles of the border
How true & some would call it karma. US territorial sovereignty starts bout 14 miles from the shoreline & every point in FL falls within the 100 mile ICE limit. FL can really legally be a test case for surveilling, stopping & questioning ALL ppl, i.e., a gestapo run State.
ICE agent: Are you a US citizen? Me: Fuck off, you disgusting piece of shit.
#UnconstitutionalAF #ICEMonsters #RacistICE #ThisIsRacialProfiling #ThisIsWhiteNationalism
Friggin gestapo.
Show me your papers. The USA is looking like Germany 1940s. And we all know how that ended.
Not that it's right, but don't they construe it so that basically the entire country is the border? Like if there's an international airport anywhere in the general region?
I didn’t realize you needed to be a citizen to legally work.
I tried to find a map of areas where Border Patrol has authority. Most look like this But, it shows half of Wisconsin included, however Lake Michigan is not international waters. And does that restriction include ICE? This would be good stuff for some smarty pants attorney to figure out and share!
Turns out ICE has jurisdiction throughout the USA interior, while Border Patrol is limited to 100 miles from the border. www.ice.gov/careers/faqs...
And people take pleasure in this.
Are they trying to claim it's a "Constitution free zone", as done during the reign of Bush the Younger? If not, was the Fifth Amendment suspended due to martial law?
Jump!!!
All of Florida is within 100 miles of some the coast.
They’re looking for people to kidnap. People of color, children, old women, whatever their kink is.
