It's standard fare. And while they have the burden of proof if they bring suit, they also have the right of discovery. The implication is that Liv would cover her tracks by destroying inculpable evidence (or evidence that would show liability) - which is a joke.

Discovery has a pretty high bar for Libel and slander. It’s part of the game but almost never obligatory for a defendant, unless it would help their case

Yah... a guy who apparently did actually attempt to hide (or at least obfuscate) evidence; but at this point, we'll never know. All the banker box shuffling that went on... one bathroom to the next to the plane... to the underpants drawer. Oh well? In any event discovery should be amusing.

Her attys should reply that of course she has documentation confirming everything she said and much more, already safely secured. Further, that his threat includes false and defamatory statements for which he would be held accountable via those same documents if he persists in this matter.
