The 8th amendment applies to punishments and deportation isn't a punishment since it's a civil matter, even though it is clearly a deprivation of Liberty.

If we are not sending people to their countries of origin, then we are sending them into exile, which has always been an extreme form of punishment. And if calling it a civil matter makes inflicting harsh punishments allowable, then our laws are worthless.

I don't disagree but immigration enforcement is still a civil matter and the executive also claims they can do whatever the fuck they want, which is then usually rubber stamped by SCOTUS
