That is actually what is going on in oral arguments. Justices are not trying particularly to learn things from the lawyers (the briefs are much better knowledge vehicles). They are making arguments to the other Justices in their only joint "discussion" moment.

Yes. In order of seniority. When Rhenquist was a newby Associate Justice he said that the order should be changed from least senior up to the chief. But he told me one summer in Austria (we were teaching at the same program), "But once I became Chief I recognized the wisdom of the traditional way."

But isn't that a great encapsulation of power big and tiny? Rehnquist at least knew he was describing a hypocracy. He didn't think his younger self was wrong.
