No, the DOJ wants to deport him immediately, but that would mean he wouldn’t be able to prepare for his trial. He remains in jail until the judge decides whether prosecutors have the power to stop him from being deported.

No, they wanted to avoid unambiguously defying the SCOTUS-blessed court order to return Abrego. They created a scenario to claim they (maliciously) complied with the order that would align with their precious narrative that these are vicious criminals.

This is a Catch-22. If the charges are dropped, DOJ says they’ll deport him to an unnamed 3rd country.

If the charges are dropped he’d be released instead of transferred to ICE detention while awaiting trial.

That isn’t what DOJ said would happen. They said they’d deport him immediately.

Difference being no charges compared to awaiting trial. What means would they have to transfer to ICE if no trial is pending?

No criminal charges just means they can claim his lack of legal status here means they can deport him (to a third country that isn't where he's from, since his claim of asylum is based on asserting that sending him to his home country would present a danger to him). (1/2)
