I personally don't prefer to call things I don't think should be rights 'rights' even if there are laws on the books protecting these things. I also use 'rights' to refer to things the law does not guarantee. I don't think it's wrong to say "x is a right and we need legislation protecting it"
or "y is not a right and legislation enabling it should be repealed".
