When you ask to come into a country, they can say no. Sadly, other than your country of birth (exceptions), you have no right to vacation, travel, visit, work, or live in another country where the government hasn't given you permission. It's a sad state of affairs.

This is a violation of the First Amendment. And before anyone tries to suggest that a foreigner doesn't have First Amendment rights, I would encourage you to read the text. It says "Congress shall make no law..." It doesn't grant rights; it restricts the government from doing exactly this shit.
When you are at the border for inspection, you aren't yet in the US, even tho you are on US soil. Case law says that in those circumstances, noncitizens are not fully protected by the Constitution (e.g., CBP can search their phone without a warrant). That said, this case seems like real overreach.

The argument needs to be made in Court, but there are barriers to bringing a case that have precluded anyone from making this argument in Court and then making this how things actually work.

The extent of presidential powers has waxed and wanted, right? This is the presidency that has abused actual powers and aggregated unto itself, illegally, even more of them. Ignoring federal courts, Posse Comitatus, over-ruling governors about state matters ... they didn't count on a sociopath.
There isn't anything in the constitution that limit presidential power because the writers found out it was unncecessary. As an old programmer I used to write code to accomodate the WORST case scenario first and foremost.
1 But there were limits. The Legislative and Judiciary branches had powers the Executive did not. They expected bribery. The influence of foreign states or actors. They didn't envision the whole govt being turned over to greedheads and fascists who hate ordinary people.
2 They provided for the common defense -- against outsiders. Not wholesale treason with no judiciary to check it. A lot of the powers he's taking were explicitly assigned to other branches. He's violating the Constitution by assuming them. They weren't seers. They imagined a lot, but not this.
The judiciary is partly under the executive, and the executive has too much leeway (like the pardon power, that should NEVER be given directly to an head of state having also emergency power).
Never mind the founding fathers. Why didn't the Democrats codify some limits in 2021 and 2022 when they had power?
Because of priority of sources. Trump doesn't care about normal law and use it's "nobody can stop me" as a way to sidetrack normal law because the constitution is TOO VAGUE about his powers and restraints. No law could stop him, only a CONSTITUTIONALLY FIXED barrier that's beyond his reach.
For example he's trying with all his might to find a way to do a third term, and he's struggling because that's not allowed and he has no power to force that.
