You’re misquoting him. He did not say that the short and cryptic orders are because they “CAN’T”reach a consensus, he is saying the short and cryptic orders reflect the consensus (though minimal) that they reached. That makes them precedent.
Every Supreme Court opinion reflects the consensus reached by the justices in the majority. Some opinions reflect greater consensus than others, but they are all precedent nonetheless.

As a lawyer, I believe any "unprecedential" order is, in fact, precedent. It's what the court actually did in a given case. A court should not be able to avoid responsibility for what they do by simply labeling their actions.
