There is a simple way to avoid having it called the "shadow docket" and that is to decide cases by (a) waiting for appeals to run their course and (b) authoring opinions explaining the reasoning behind decisions. GOP SCOTUS refuses to do either, instead deciding major cases via the shadow docket.

I can think of exactly one case where the Delaware Supreme Court decided anything similar — after expedited briefing and full oral argument, they issued a one paragraph order reversing the judgment below, saying an opinion would be forthcoming. They issued a full opinion like two months later

(The case had been “is a misdemeanor for misconduct while in public office an ‘infamous crime’ that disqualifies the person from state public office in the future?” They issued the immediate reversal to allow him to be sworn in, and the full opinion to explain their reasoning ASAP thereafter)

IANAL, but if I had to guess then I reckon this prob has something to do w the court having been captured by a dangerous cabal that uses sneaky and improper methods to get it's way.

Either SCOTUS can stop treating other courts, and the American people, as complete dupes, or it can continue doing that.
