Ethan is legally in the right. You can think what he's morally doing is wrong but from my understanding of copyright he is legally correct.

Nintendo is "legally correct" when they threaten to sue some rom hack creator. It doesn't mean they're popular or good for it when it threatens people's ability to make fan works
