1) It's only banned by their state constitution if the state supreme court (which is controlled by Republicans) says it is. 2) They know most voters won't notice (at least enough to rise up and do anything about it) and those that do can be slapped with felony convictions to prevent them from voting

3) They have to get elected every other year but the electoral maps and rules (as well as voter preferences/demographics) are so much in their favor that they never have to worry about losing their majority. Laboratories of Autocracy by David Pepper is a good read.
