Does FASORP really have the ability to create an obligation for students to preserve their personal statements? Isn't that kind of obligation created only after a lawsuit is initiated?

A lawsuit doesn’t have to be initiated, only “reasonably anticipated.” But there are numerous other issues here, including students not being party to any potential lawsuit and having no obligation to preserve records.
