Exactly. They aren't going to push for prosecuting treason (Reagan) or war crimes (Bush) b/c what if one of their guys needs to do a little war criming (Obama)? They may not be as egregious about it, but they ultimately don't want to set legal precedents that they might one day find inconvenient.
