The number of local law enforcement agencies formally partnering with ICE has exploded since January. Here's what ICE tells local authorities they will get from these arrangements. In reality, 287(g) agreements have resulted in a host of problems for agencies and communities across America. 🧵

Flyer titled “287(g) Benefits” from U.S. Immigration and Customs Enforcement. The main headline reads: “Your Agency + Federal Law Enforcement = Safer Communities.” Text explains ICE’s 287(g) Program, which allows local law enforcement agencies to enforce certain aspects of U.S. immigration law. Agencies can identify and process removable immigrants with pending or active criminal charges, enforce limited immigration law with ICE oversight during routine duties, and serve administrative warrants on immigrants in jail. Listed “287(g) Benefits” include enhanced public safety, free training, and possible eligibility for federal payments. Instructions for signing up mention submitting a letter of interest and memorandum of agreement to ICE. Section titled “3 Ways Your Agency Can Join Forces With ICE” describes three models: Jail Enforcement Model, Task Force Model, and Warrant Service Officer Program. At the bottom, it directs readers to ICE.gov/287g for templates. Right corner features an illustration of two uniformed officers labeled “POLICE ICE.”

Mainly, local agencies get stiffed for hundreds of thousands of dollars in lawsuits for false imprisonment suits when ice screws up, then wanders off when it comes time to pay the bill. Clackamas County, Oregon got stiffed for over $200,000 + legal fees and ice was entirely at fault. “Oops, my bad.”

Researchers and the DOJ itself have found that 287(g) programs have resulted in increased racial profiling. Beyond being inherently harmful, this can also create massive costs for taxpayers.

Even without lawsuits, the program can be very costly. A few estimates that have been shared: • Harris County, TX - $675k/year • Mecklenburg County, NC - $5.3M for 1st year • Alamance County, NC - $4.8M for 1st year • Prince William County, CA - $6.4M for 1st year More info and sources here:

In recent weeks, local law enforcement have expressed dissatisfaction with their ICE partnerships for other reasons.

287(g) agreements don’t make communities safer. A 2018 study by the Cato Institute found no evidence that these partnerships reduce crime rates.

Law enforcement leaders have recognized that when local agencies partner with ICE, it can actually make communities far less safe.

Black serif text on a yellow background with a quotation from the International Association of Chiefs of Police (2005). The text emphasizes that local police rely on immigrants’ cooperation to solve crimes and maintain order, but fear of immigration enforcement and deportation deters many from coming forward, even when serious crimes are committed against them or their families. Yellow serif text on a black background with a quotation from the Major Cities Chiefs Association (2019). The statement warns that without assurances that police contact won’t trigger civil immigration enforcement, the trust, communication, and cooperation of immigrant communities with police would vanish.
