You're talking about a different thing. Being in the country illegally CAN lead to criminal offenses. But it is not, in itself, a crime. It is a civil violation. That's why they get deported instead of jailed.

the constitution in no way says to leave the borders open and just let in anyone even if they don’t provide identification so you can’t check whether or not they’re a criminal in their own country. and WHY so many are here illegally is because their countries fucking suck and we give them free money
