"Least evil" would not be a fallacy, but "lesser of two evils" can suggest forcing a dichotomy and hiding other choices, which would involve fallacies. This is why it's often called a fallacy.

it's not on any logical fallacy list, but I understand the problems with it. it acts like a truism, but is actually false. but the logic being bad based on the evidence isn't the same as a fallacy which has a structural error, instead of a value error.
