Yeah, it matters that in this flight attendant case the government just kool-aid manned its way into (at best!) a legal gray area. That's rare! The legal machinery usually works!

I think the AC flight attendants case is a perfect example of what happens when all parties - not just the government, and ESPECIALLY management - are so used to the preventative machinery impeding real harm that they stop taking care and being deliberate and intentional.
