Yes but I expect this particular argument, that the populace who elected Trump will demand a dictator if Trump’s will is curtail by the judicial branch, may hold water with people like Roberts. The thought being that if they stand in his way, then they too will lose their power.
It’s a ridiculous argument but Roberts may be just short sited enough to believe that his need to preserve the court is more important than his duty to preserve the constitution. It’s the tack I’ve been expecting them to take but I think this first “argument” I’ve seen in the wild.
