With her being a public figure and it being hyperbole, opinion, and insulting there's not a case there.

Ok, but that never stops Trump. The lawsuit is the point. The news about a lawsuit is the point. The fight is the point.

The lawsuit will just allow him waste more DoJ funds and time defending himself and a lawsuit is going to move zero public opinion on the Warren issue. There is no point other than wating resources and time Warren could better invest elsewhere.

I’d say the malice component is provable. And he’s calling her a drug addict.

Legal malice is not the common definition. Plus doesn't matter since its all hyperbole and insults.

And his dimentia would probably disqualify any further defamation lawsuits. Too bad it hasn't disqualified him from his current position yet.

I’d be interested to see his lawyers introduce evidence that he has dementia as a defense to defamation. I bet JD Vance would be really pleased. #25thAmendment

I was saying his lawyers would never introduce dementia evidence as a defense.

He will get DoJ to defend him and the case has 0 chance. He won't pay anything.

Seems like actual malice (reckless disregard) to me. And there was no disclaimer by Trump. I think his statement (“gotta take a drug test”), though not explicitly saying Warren uses drugs, can still be defamatory if it implies she does, and the implication isn’t true, is reckless, and causes harm.

It would be seen as hyperbole and insult. To get past that you would need a more factually detailed claim. Time/place/drug type/etc.

Then you should come out of retirement and pitch the case to Warren. Given his track record for hyperbole and insults and lack of detailed claim its going nowhere.

It also follows right after calling her a nut job. Adding additional context to it being insult.
