Hamas attacked Israel. Israel is destroying Hamas and civilians are being killed as well, apparently on purpose. Those are war crimes, because it’s a war.
The questions are: Are civilians being killed on purpose, even if no military target is close? And secondly: Are the civilians being killed in an attack completely out of proportion to the value if the military target or could Israel have used other weapons to minimize civilian loses?
If yes, then it is a war crime. If no, then it is just a horrible war. It is also to be seen, if the fact that the enemy (Hamas) fights without uniform and blends in (hides behind) with civil population, affects the judgement of Israel's actions.

There is just no case for using the term genocide. And it is not what the ICJ is accusing Israel of. What is the case, is inadequate protection of civilians under military action. Which Israel might, or might not be guilty of. But the case should see court, as jurisprudence should be established
