IMHO, it is the verbalization of the oath that matters. He said the words. Therefore, he made the oath. There is no magic about using a Bible. When military members are sworn in, they don't use a Bible. I do agree that it was intentional but stupid because he actually spoke the oath.

I agree, but somewhere in his psyche he can use this to rationalize, kind of like a child who crosses their fingers behind their backs when they tell a lie.
