She may be betting they are afraid of what will come out of discovery and this may just bring him home right away to make this moot. But sanctioning the DOJ and potentially senior members of the US Government is not something a judge wants to do without a clear record.

Trump and his ilk will fight bringing him home like a tiger. The last thing they want is for him to have an interview with ANY journalist, including from the RWNJ propagandists. Before he returns, there'll be a "tragic accident" where he is killed or rendered incapable of any form of communication.

Prosecutorial discretion and judicial process isn't the same. The judge has been clear, the DoJ belligerent, but the escalation has to be measured. It's necessary to push this constitutional crisis to it's collision, but it must be incremental to avoid violence. It's not good, but it's right.

Building a case takes time. Smith’s real problem wasn’t his pace- it was the Roberts Court making Trump effectively immune for official acts and creating a presumption of immunity for anything remotely connected to the office or executive branch officials. (And Roberts delayed even that ruling)

Agreed. I know Smith tried. But he was also trying to make it perfect. You want to be prepared if bringing charges like that. I don’t blame him tho. Although only took a few weeks to get rid of Nixon and he was a sitting president. Back when GOP had some sense of shame or morals.

There's a post at Democracy Docket proposing what judges should do if that happens. There's language in the rules that allows judges to appoint someone to take the place of the Marshall. Author suggests local law enforcement could do the job.

Yes they did. They did not think it through. Their objective was to aid having a Republican in office no matter what. And if a Democrat somehow gets in and tries to use the powers they have granted Trump, suddenly the Supreme Court would find a way to claw back those powers 🤣 It’s cynical!
