Oh it matters. Everybody that participates in the deal is guilty. Only the president would allegedly have “immunity” from official acts, not anybody else.
Assuming one could gather the evidence. If a secretary accepts the bribe at the direction of the president, Trump v US bars communication between the secretary and Trump from use from being used as evidence in any trial, even if the defendant has no immunity.
Imagine all the internal communications at paramount and other companies considering the legal pitfalls, those are all admissible. Breaking the law at discretion of others doesn’t disavow legal liability. They know it’s a bribe and to proceed is accepting the potential legal consequences.
I hope you're right. I just have very little confidence in our ability to prosecute corruption right now. The judiciary has seriously weakened our anti corruption statutes - not just with Trump v US, but other cases like Snyder v US. Again, I hope I'm wrong. But I remain pessimistic.
