Some more info. 1) Per a friend that works in NY state government, NY cities are required to hold funds in commercial banks. So this was a private bank account, not one controlled by Treasury. 2) Per NYDN the inbound wire was dated Feb 4; wires are one-way, they can't just be undone a week later.

Wire transfers and ACH payments can be recalled. The receiving bank doesn't have to return the funds but when it's the Federal government requesting the funds be returned banks aren't really in position to say no.

ACH guidelines allow a reversal within 5 business days of settlement. That suggests to me that this was a "reversal" in the technical sense, given funds were credited to the NYC account Feb 4 and debited on Feb 11 (5 business days later).

The mechanism you’re describing allows them to “freeze” an account at a bank subject to US jurisdiction, but actually seizing the money that way would take longer. It would have to be a different method, perhaps one of the ones allowing the Feds to claw back a mistaken payment.

Yeah, an ACH sender *can* reverse any Credit. If the money is in the account, the RDFI bank has to pay it back. But there’s very limited circumstances for that under NACHA. The Treasury is under different rules, but I’m guessing it’s not allowed under their rules either.

The Treasury can deposit and withdraw funds from US domiciled bank accounts without friction. All US banks are connected to the Treasury by law - it is a condition of possessing a banking license. No bank questions Treasury transactions, the have priority over all other transactions.

Well I can give some context base on what the IRS can do. The IRS can issue a levy on bank accounts...BUT...not without, appeal rights and due process. No notification or legal actions would be illegal for the IRS to do that. I can only assume that Treasury has the same process and notifications.

IF ACH: ACH debits are based on a trust system for the ACH originator. Proof permission for a debit isn't required until it is called into question by the ODFI due to a claim of a fraudulent debit. Most accounts don't have ACH positive pay setup which would require positive approval of a debit.

If you have account information for someone, I believe you can pretty much run an ACH or a wire into or out of that account. I think all you need is routing number and account number. It's assumed that if you are initiating a transfer from a trusted institution then you aren't committing fraud.
